For Sac rapes that occurred in 1978, the SOL would not expire for 6 years, or sometime in 1984. For Sacramento now to claim that they destroyed the evidence because of the expiration of the SOL, the destruction of evidence had to have occurred after 1984.
But by 1984, the Maggiore murders had long since occurred. Since they "say" they suspected specifically the EAR, of being the killer, they should have preserved the evidence because it could have been used in a murder trial of the EAR.
In other words, despite Sacramento's claim about the SOL, the EAR evidence should never have been destroyed because, according to Biondi, Sacramento suspected the EAR of being a murderer in 1978.
