Attack # 28 took place in Foothill Farms on December 3, 1977.
I am not suggesting this was not an EAR crime but there are some differences in MO and odd circumstances.
First, here are the prime similarities with EAR: 1. A burglary a few months earlier where photos were taken. 2. There were phone calls. 3. Shoelaces were used. 4. He talked with clenched teeth.
Here are the oddities in my opinion:
1. The victim's husband left the house at 11pm to gamble with friends. That seems a little late to be leaving, though not unheard of I guess. There is no mention of his return, at least before 3 am. Interestingly, there is no mention that the attacker asked about a husband or asked about when he would be back. Did the attacker know the husband was going to be out?
2. The attacker never said he wanted money
3. The attacker was very quiet, did not say much.
4. The victim did not see a gun or knife.
5. Apparently 4 or 5 young kids were playing outside. While it was a Friday night, 12-1 a.m. seems a little late for "young" kids to be playing outside making a racket, especially on a misty December night. Also, it's interesting that the attacker would choose to break in with the racket going on just outside. Maybe the kids didn't start playing until after he had broken in?
6. There was no rape. The speculation is that the kids were distracting. Also, the victim was older (36) and larger than the attacker may have believed from pictures.
7. There was no ransacking and the attacker took nothing from the house.
8. The victim believed she heard a van leave at the side of the house. For some reason, she was quite positive it was a van. That is odd because how could one know it was van without seeing it? Maybe he mentioned it was a van as he had done in other attacks and the victim conflated things. The kids never mentioned noticing a van or anything else odd.
I have often thought about why the EAR thought the kids were being smart?
As he looked out the window at them the victim heard him say something like,
"You think you're smart, but I'm smarter than you."
