SIGHTINGS PRIOR TO MURDER
Witness #4
One witness, an eleven-year-old girl, described seeing two men walking westbound on La Gloria drive a few minutes prior to the shooting. She reported they crossed from one side of the street to the next, but did not seem to be in a hurry. She lost sight of them just before they reached the intersection of La Gloria Drive and West La Loma Drive. This described travel route was walking away from the crime scene, though a few minutes before the crime. She heard the shots approximately 3-5 minutes later. This witness made three separate statements, the first being on February 10th. 1978. Her story remained consistent as to the behavior of the two men, but the descriptions varied somewhat with each statement. She was able to assist a sketch artist in composite drawings of the subjects, which were then widely circulated as persons of interest, though they had been see prior to the crime. The eleven-year-old witness viewed numerous photographs in the following weeks of men who were suspected of being one of the two men. After reviewing an abundance of photos without honing in on any of them, she ultimately selected a subject whom she felt appeared to be the mustached man that resulted in one of the composite sketches.
When interviewed two weeks after the murder, the man selected by the eleven-year-old stated he was in the area walking to Taylor Park/Cordova Meadows Elementary School alongside a friend. He also provided the route of travel he believed they had taken to reach the park. The friend he identified confirmed he was the second subject and corroborated the story, but outlined a different route he thought they took — although both agreed on a generally south-to-north travel route from the area of La Loma Drive/north of Folsom Blvd to Taylor Park/Cordova Meadows Elementary School.
They each stated they had just arrived at the park when they heard shots fired. As their story could not be independently verified, and they couldn’t agree on the streets they were on, detectives continued investigating them and were especially focused on the mustached man. This man was the only subject ever identified by the eleven-year-old girl, who was later shown another group of photographs containing 46 suspects. She again selected the same mustached man who had put himself in the area on the night of the shooting. She said she didn’t recognize any of the other suspects as having been on her street that night. The investigation had put both men in the area, and while they were the men the girl saw, their direction of travel was away from the crime scene and a few minutes before the crime. A polygraph taken by the mustached subject indicated no deception. Though the two identified men were being extensively investigated , the composites were still used as the investigation progressed.
Detectives of the era were divided on the involvement of the two men seen on La Gloria Drive a few minutes before the crime and walking away from the crime scene. They were also divided on whether the two men were the same subjects as those resulting from the identification by the young witness and subsequent interviews and investigation.
One fact beyond dispute is that the eleven-year-old witness only identified a single man from the dozens of photos she was shown, and that man stated he was in the area with a companion who stated the same. He bears a striking resemblance to the composite sketch.
The current detectives assigned to this case consider the "two men" seen walking away from the scene minutes before the crime a closed lead.
