Some Troubling Aspects of the EAR Case

Hi All – Longtime lurker and case follower here. I am having real trouble reconciling these problems: I apologize for any evidence errors.

1. Attacks 7 & 8:

These attacks occurred on 10-18-1976 on Monday. Attack 7 occurred at approximately 230AM and I am going to assume was over between 4AM and 5AM. This attack occurs in the SC-B cluster.
Attack 8 happened at approximately 11:00PM on the same day the perpetrator surprises the victim in her driveway and attacks. He ties up the victim, but does not rape and steals her car and drives it a short distance where it is ditched. This attack occurs in the Rancho Cordova SC-A cluster. This cluster was the most intense area of activity. The driving distance between attacks is approximately 17 to 20 minutes / 9 miles.
When considering this short amount of time, sleep deprivation, employment, and the attack logistics involved; I believe that these attacks likely were not committed by the same individual. These facts leave me asking why does LE believe that these two attacks were committed by the same person?

2. Davis & Modesto Attacks:

I am really struggling to understand how these two attacks can be attributed to the same individual. The logistics involved in committing these attacks suggests the possibility is slim. I do not live in the area, but I have driven these highways many times for vacation and work in California.

• Attack 35 occurred in Modesto 6-23-1978 at approximately 1:30AM and ended around 3:00AM.

• Attack 36 occurred in Davis on 6-24-2017 at approximately 3:00AM and lasted an hour.

If the EAR was based in Sacramento, the drive distance and time to Modesto is approximately 85 miles / 1 ½ hours each way. If the perpetrator used a vehicle as the getaway method, at least 3 hours of time would be needed to for this event.

The distance and drive time from Sacramento to Davis is about 30 miles and will take approximately 45 minutes each way totaling 1.5 hours. I would like to ask LE why they feel confident that the Davis and Modesto Cluster are the work of a single assailant?

3. DNA linked crimes:

There are no Sacramento DNA linked crimes. All links to Sacramento are based only on MO which is subjective and I believe ligature knots that were used in some of these attacks. Why does LE feel that the DNA from San Ramone, Danville and Southern California would be from the Sacramento EAR?

4. Sketches: I see many different looking facial sketches. The FBI seems to have compiled these drawings into a composite sketch. IMO – I don’t think we even know what this individual or individuals looked like.

5. Troubling Rabbit Hole Assumptions that plague this case:

• Unified Theory – VR linked to EAR, Sacramento EAR linked to North California EAR crimes and to Southern California ONS. In all my reading, I am still struggling to understand why LE believes 1 single person committed all of these crimes, Why?

• The Maggiore’s – Conflicting eye witness accounts and speculation regarding possible drug ring at the Airforce Base for this incident. It does not seem that there is strong definitive proof that these crimes were committed by the EAR. Was this EAR even the same person as the perpetrator of the DNA linked crimes?

• The Punishment Map – No definitive proof either way that these papers belonged to the EAR. Not saying it was not written by the EAR, just that it is not DNA type evidence. Seems like a lot of resources have been expended on this map.

• Excitements Crave – No definitive proof either way that this was written by the EAR. Not DNA type evidence and the possibility exists could be a prankster.

6. A link between the perpetrator and victim: No links found yet to any victims, yet we all feel one or two must exist. What are we missing?

These factors make it extremely difficult to do a big data searches and find linkages between the perpetrator and victims. For example, Sacramento County had 52,403 male births between 1945 and 1957. This list can be reduced by race, death and movement; then cross referenced with school records. But, what if……. worst case scenario the perpetrator of the DNA related crimes never lived in Sacramento and only committed crimes on the 680 corridor and in Southern California. This creates a big conundrum because it is extremely difficult to quantify the scope of a big data search. Worse it seems impossible to link the San Ramone, Danville, Goleta, Irvine and Dana Point crimes together. This leaves me wondering what I am missing or that LE knows that is not public?

Anyway, I would like to believe that a big data search would be able to produce some good leads.... knock on wood.  

I have no POI’s or anything to get people excited. Sorry to disappoint. From what I have read, I believe that the EAR or EAR’s have a military background and was involved in land development occupations whether that is real estate, construction or other employment; I do not know.
Seems like some people here are working these angles behind the scenes and I wish them the best of luck. The victims and their families deserve closure.

I agree that this seems like different people, that being said LE could be withholding info about his MO, something that only this guy would do. Much has been said about his MO on this board that LE hasn't released (speculation of course) but I feel if LE thinks they are related then they are related.

You make so many great points. We share so many of the same questions and skepticisms about the attack connections, especially the points you make about the frequency of some attacks and the traveling fairly long distances and yet not staying for hours on end like he did with so many other cases. Great post and I'm looking forward to more of your insight!

Just to address something real quick before I try to answer all your other points, you are right about The Punishment Map/Homework Pages. They may or may not have been written by EAR. It's entirely likely that EAR had them, but they could have been stolen from another student in school and so forth. There is no legitimate proof they have been written by him, other than the fact that they were found where EAR made his getaway in his vehicle (bloodhounds tracked the scent). As for Excitement's Crave, that is more than likely written by him for numerous reasons. If I remember correctly, the typewriter used to type up the poem was the same model of typewriter EAR had stolen from a prior victim, either four months beforehand or somewhere along those lines. Also, the police and news station received the poem the following day when EAR made his escape on the Watt Ave bridge, of which he told the police he would attack in that area. However, he did not strike on that night (that we know of). I hope that clears some air on those questions you asked. I'll go back and address the other questions soon.

Those are Interesting onservations dagglebort, and your questions are all relevant. You are right that there is no DNA evidence linking the Sacramento and Contra Costa County crimes. But there is a lot of circumstantial evidence. Too much for me to list, and tbh, there are others here who know it all off by heart and are better suited than me to name some of the stronger evidentiary links.

However, your mention of attacks 35 and 36 caught my attention. I believe 35 was the one that involved a taxi driver picking up an individual with a handbag from the local airport and dropping him off adjacent to a recently developed housing tract, not far from where the attack took place. It was strange enough that he reported it to police after news of the attack went public. So, my guess is that the perpetrator — if also the perpetrator of attack 36 — caught a return flight back to Davis the next day, in time to commit another attack. It may not make a lot of sense, but this whole case is baffling in so many ways. Your list of anomalies can easily be multiplied by ten or more. There may indeed be some canonical attacks that were not committed by EAR/ONS. Likewise, there are probably other, unreported or non-canonical attacks that were.

The whole case is a puzzle and you are right — the perpetrator or perpetrators need to be brought to justice, above all. 

I hope you keep posting here as you seem to have a lot of knowledge about the case and have obviously put a lot of thought into it.

Thanks for the reply, the airport link is very interesting. I am going to assume any flight between Davis and Modesto would need be a privately chartered flight even at that time. I don't believe Modesto County was a commercial airport at this time. It's not now.

Welcome! Great questions.

By themselves, Attacks #7 and #8 do not provide solid links to each other at all. The similarities of #8 to #4 (the approach in the driveway and the car stealing), and the similarities between #8 and #9 (the leading the victim away from the scene to a prepared area), in addition to the phone call received by the victim of #8 in December 1977 when various other EAR phone calls were made and the area it occurred in, leads investigators to believe that #8 was indeed an EAR attack tied to the other EAR attacks in Sacramento. The ties between #7 and the other attacks are numerous.

The timing is indeed bizarre. Broken out further:

Davis:
June 22nd, 1978 - Suspicious man seen on Shire Lane.


Modesto:
June 22nd, 1978 Evening - Man at airport hails cab, gets dropped off near attack site.


Modesto:
June 23rd, 1978 1:30 AM to 3:00 AM - EAR attacks on Grandprix Drive.


Davis:
June 23rd, 1978 8:30 PM: - Man seen peeping over a fence.


Davis:
June 24th, 1978 3:15 AM to 4:15 AM - EAR attacks on Rivendell Lane. Dog tracks suspect to nearby UC Davis airport.


It's very unlikely that the assailant flew out of Davis due to the part of the airport that the bloodhound tracked him to, and if he was dropped off at Modesto then transportation becomes a huge question mark. Also, figuring out when he would've slept in between attacks is difficult.

M.O. links among the Modesto/Davis attacks are extremely strong though (especially these two), from the verbiage, to the crying at most of them, to the general flow of the attacks. They were extremely regimented and scripted. My theory is that the EAR, for whatever reason, was under time crunches during this phase and there were time windows where he had to use his intel or else he wouldn't get other opportunities.

The evidence goes far beyond the ligature knots. The DNA-connected attacks, especially #46 (the one on a couple), play out exactly like EAR attacks #16 and up in Sacramento. From the masturbation in bound hands to the verbiage used to the dishes and "van" mentions and the order in which things were done, they read exactly the same with only minor variations. Occasionally the dogs would recognize the scent from one attack to the next. I spent the first year of my interest this case with a lot of skepticism that they were the same perp, but gradually started to see irrefutable connections. One of the "aha" moments was knowing that there was physical evidence tying the failed Goleta attack to the O/M murder and working backwards from there, connecting #18 and #27 through identical phone calls, #25, #26, and #27 through paint and then a similar paint being found at O/M, and from there I started branching out into other obvious similarities among the attacks until they were all connected like a spider web. I prefer physical evidence, but in lieu of that I've accepted some obvious M.O. links as well.

Despite the best efforts of witnesses and professionals, I feel that the sketches are not terribly useful and I've spoken to a lot of LE who feel the same way. There was nothing terribly distinctive about the offender's physical appearance.

Unified theory: I would not link VR to this crime series. The other ones have pretty strong links -- most of them being simply a homogenous pattern of attack and a very regimented series of steps that almost every attack went through, not to mention similar calls received by large swaths of victims at similar times. Some of them dangle out further than others, but the ones that I can't personally bring all the way into the fold don't affect my sense of the perpetrator very much one way or the other. If #43 or #30 wasn't him, what does that change, really? I'm confident that a handful of Sac ones can be tied to CCC, and confident through physical evidence that CCC can be tied to all SoCal murders, so I already have everything of value in just those attacks. The various Sac attacks don't really add much to the picture that the DNA-connected NorCal ones don't already contain.

The Maggiores: It may or may not be linked--I guess it depends on what you think of Ripon Court, in a few different ways. The main purpose that Maggiore would've served would have been to skirt the statute of limitations and keep the rape kits in the evidence locker, but it didn't come through for us. That being said, there was EAR-style activity in the area at the time, and after studying it I personally believe that it's linked. 

Punishment Map: Other than being found at the end of the dog trail, nothing too exciting about it. The reason its gained prominence in recent years is because it was overlooked for so long, and this case is thirsty for new leads. Investigators are doing their due diligence by exhaustively checking it out.

Excitement's Crave: There are up to four more unreleased letters and poems so I'll decline to address this for now. Either way, it doesn't add much for us to work with regarding identifying the offender.

One may exist or it may not. I personally believe that most of his victims were chosen through voyeuristic means, which would make the primary link simply geography and being in the wrong house at the wrong time. I don't feel strongly about the military angle. Military connections existed heavily when he offended in the East Sac area, but dissipated once he left it. East Sac had a heavy military culture--most of the other areas did not.

Thanks Kindly - My parents would take us to Norcal for vacation when we were kids. Especially to Sac Zoo, Railroad Museum and for school shopping. This was during the late 70's and 80's.  Anyway, having driven from Sac to Stockton and back many times. Then passing through Davis on my to SF really makes me wonder about the logistics of those 2 attacks. Not only the distance, but at certain times you could be fighting traffic. Just seems weird.

It just seems too random that all these crimes within a 3-4y period in different areas would happen amongst a few rapists who didn't know each other. Alot of them have the same type of MO to be happenstance. I could be way off but it's just a gut feeling, that they all worked together in scouting, surveilling and alternating in attacks. It's possible there was a copycat that committed a few but i think it's unlikely.

The problem with the Big Data search is that, if you make any incorrect limiting assumptions about the pool to be searched, you will not find the person.

For instance, I have three people whom I am fairly sure did not complete any of the attacks because I can account (or think that I can account) for their whereabouts during some of the attacks, but all had opportunity. The BigData proposed search would miss them all.

One was a drifter with no mailing address who probably never drove in California during the period of attacks (and certainly never registered a vehicle).

One lived in Santa Barbara or San Luis Obispo county and only ever stayed with friends in northern California.

The other is too young.

If you want to catch the tiny purple fish, you need a large net with very small holes! The problem is that you will also catch a lot of red herring in the bunch.

As for searching records:

Could EAR have been a Soviet spy or illegal alien from one of the Nordic countries? Maybe the Soviets recalled him in 1982, brought him back for a few weeks in 1985-6 and he was here on vacation 1991 or made the call from Russia. Do you think that that guy would show up in your records search? Especially, if he used a couple different names.

The only data alibis that would let you exclude someone as a suspect would be land line phone records of originated phone calls and credit card records all of which are long gone. But, Soviet spies could probably spoof a phone line even back then and probably even fake credit card records. It seems like it would have been basic spy training even then.

If he were ex-Soviet navy, the knots would just make sense.

The frequency of attacks within a 24 hour period as previously mentioned and the vast spectrum of victim descriptions keep me thinking we could have two offenders. Which would suck because only one would be brought to justice.

Have a read about the Duffy and Mulcahy railway rapists case from the UK.

Two serial rapists/murderers working together, with Duffy also acting alone at times.

The surviving victims mentioned two attackers, yet the public investigation (and famous profile by Dr. David Canter) seemed to suggest one offender.

Duffy was identified (because he matched 17 of the 19 points in the profile) and sentenced to life in prison.  

The case is declared to be solved.  I don't think anyone in LE or the media were saying that one of the two railway rapists has been caught.

Fast forward a decade or so, and Duffy announces that he had an accomplice all along.  He names his boyhood friend Mulcahy.

Mulcahy is arrested, tried and also sentenced to life in prison (IMO in an extremely dodgy and open to reasonable doubt way).

I think that Mulcahy was almost definitely guilty, and that the police were willing to do almost anything to secure a conviction for their long term prime accomplice suspect, but can't understand why the accomplice angle didn't seem to receive any publicity during the investigation or aftermath of Duffy's conviction.

Canter's profile of this case is often lauded, but missing out that the offender would work with an accomplice is a pretty big omission IMO.

How and why did Dr. Canter's famous profile just happen miss that there were two rapists?

A question I would ask about this point (and I don't know anything about typewriters in the '70s, as a 30ish person) is what is the base rate of that typewriter model in the typewriter-owning population? Was it a field that was dominated by a couple of giants (similar to smartphones now) and was a near-monopoly? Looking at it in that way, if we were to replace typewriter with phone, and said "he made a phone call using an iPhone, the same model of phone that was stolen months before," it would seem not very compelling evidence at all. I don't want to be someone who's asking questions (potentially irrelevant ones, if these suppositions end up unfounded) without doing the research to determine the prevalence of various models of typewriters at that time, but perhaps others who are more familiar about the matter could lend their opinion. But if there was a popular model at the time, one that even say 25% of the population would own, then coincidence becomes a stronger possibility.

In regards to EC, I seem to recall that the return address was to some local poet/teacher? Wonder if LE was given a list of his students. Seems as though EAR had to have encountered this guy at some point in order to attempt to throw him under the bus.

Just to address something real quick before I try to answer all your other points, you are right about The Punishment Map/Homework Pages. They may or may not have been written by EAR. It's entirely likely that EAR had them, but they could have been stolen from another student in school and so forth. There is no legitimate proof they have been written by him, other than the fact that they were found where EAR made his getaway in his vehicle (bloodhounds tracked the scent). As for Excitement's Crave, that is more than likely written by him for numerous reasons. If I remember correctly, the typewriter used to type up the poem was the same model of typewriter EAR had stolen from a prior victim, either four months beforehand or somewhere along those lines. Also, the police and news station received the poem the following day when EAR made his escape on the Watt Ave bridge, of which he told the police he would attack in that area. However, he did not strike on that night (that we know of). I hope that clears some air on those questions you asked. I'll go back and address the other questions soon.

A question I would ask about this point (and I don't know anything about typewriters in the '70s, as a 30ish person) is what is the base rate of that typewriter model in the typewriter-owning population? Was it a field that was dominated by a couple of giants (similar to smartphones now) and was a near-monopoly? Looking at it in that way, if we were to replace typewriter with phone, and said "he made a phone call using an iPhone, the same model of phone that was stolen months before," it would seem not very compelling evidence at all. I don't want to be someone who's asking questions (potentially irrelevant ones, if these suppositions end up unfounded) without doing the research to determine the prevalence of various models of typewriters at that time, but perhaps others who are more familiar about the matter could lend their opinion. But if there was a popular model at the time, one that even say 25% of the population would own, then coincidence becomes a stronger possibility.

It was an extremely popular model (it was a Royal portable). Still kinda weird though
