New: joke & biagio interview Todd Lindsey re Armour,Richmond

Please listen to the above rather short podcast and judge for yourself.  As for my reaction, until now I have been thrilled with the programs of joke and biagio and thrilled with Todd Lindsey.  No so much with this podcast, gotta say.  Not at all!

I'll go ahead and post my thoughts on it here:

I was very disappointed with what appears to be the lack of research on their part and stating theories as facts.

For instance, I don't believe it is an accepted fact that Jennifer Armour was hitchhiking. I think one person said that, but from what I heard previously it wasn't for sure.


They don't see any connection to the fact that two blond teen age girls were abducted, murdered, 1 year apart and found very close together in a remote location.   How many bodies do they find out there. How many blond teenage girls?


They say it doesn't fit the MO of DeAngelo. Well, did Beth Snelling fit the MO of the Ransacker?  Next, they invent a scenario that he accidentally woke her up and "had to" put his hand over her mouth. And he "had to" shoot to kill her father instead of just running away or firing a warning shot.
  

So they think he came by bike and not a car to the Snelling residence. That isn't known. But that makes them think the kidnapping wasn't planned. That is really ignoring that Mr. Snelling chased off a peeping Tom previously and that Beth opened her curtains to look into the face of a peeping Tom on a second occasion. I believe she definitely was targeted and I believe it was planned. The EAR was known to remove victims from their homes and take them to the back yards of neighbors in the case of victim #9, he took her down the drainage canal a good distance.


They are putting forth the progression of violence theory, which actually makes sense, but I believe, as does many in LE believe that Eva Taylor was his murder victim. She was murdered 4/18/74 before Jennifer Armour in Nov of 1974. Larry Pool says the progression of violence theory doesn't always hold true.  Also, do we know all of his crimes?

They say there are no records for the Oscar Clifton case? They don't seem to see a problem with that! They dismiss that saying they were purged for space? What!  This was a murder case!  Oscar had not had his appeal yet but Sgt. Byrd ordered the evidence to be thrown out in 1977!  There is something rotten in the state of Denmark.

It does seem like there is a possibility Oscar might have been framed. His receipt book was dropped by the bike. Was that dropped by Oscar? Or was that dropped by a serial killer we know was working as cop in the neighborhood and whose sister lived very close to Donna Jo.  VR loot was dropped on purpose in a canal right across the street from Oscar's parents on Hypericum.  Hypericum is in the boonies.  These two things make me consider Oscar may have been targeted to be set up.   I believe DeAngelo framed people as part of his M.O. The people I believe he framed were usually problematic people known to LE and perfect patsy's. Oscar fits that!


LE suspected Oscar wore his cowboy boots, went to his house and yet no blood was found on the boots that were in his closet. No blood on his clothes, or on Oscar's knife.  Would Oscar keep the murder weapon in his pocket? The knife also had no blood and the blade was only 2 inches long.

AND..... no blood or any trace evidence in his "dirty" truck.   It obviously had not been cleaned yet they found not a spec of trace evidence in it? There was one blond hair that they never explained to the jury was Oscar's daughter's hair.
  So the jury never hear it was his daughter's.

Big question: How did Oscar get home so fast, clean up, dispose of evidence, go out to dinner in the same clothes he had been wearing all day. Even if the worst case scenario and relatives and daughter's boyfriend lied to give him an alibi, I keep thinking of his truck!!!
  Also it is possible the boyfriend was leaned on to change the time Oscar got home, doing the opposite of giving him an alibi.  

The wheel base of Oscar's truck was 18 to 20" less than the tire tracks they measured at the scene where Donna underwear was found.  

I don't know if Oscar was innocent. He might be guilty.

Beth Brumley said he spoke pornographically to her.  Gloria Moscoro, the grove worker said he exposed himself to her. He was convicted for attempted rape of a girl at the St. John's river 10 years before.  He approached a woman at a farm house and said he wanted to have sex.  (The 12-26-75 podcasters have rebuttals to the St. John's river incident.)  Gloria's father and brother both saw a white truck and even described the shape of the tail lights yet didn't see the big black letters "F O R D" on the back, and came up with a different make.  Actually this  makes me wonder if Oscar had access to some other white pick up truck that day and if that could answer why there was no trace evidence in his truck.

One thing that looks bad that I found out rather recently and actually looks very bad for Oscar is that he had mismatching tires.  All were BF Goodrich but two were not the same as the other two and mounted in an X position and that pattern appears at the crime scene.  There isn't enough of the track to say what brand it was or what size tire only that the tread on two of the tires didn't match the other two and they were placed in a X pattern, just like Oscar's and were compatible with Oscar's. 

To me there is a lot that should be reexamined especially in light of what we now know about DeAngelo working as a cop in Exeter.  Some independent outside agency should come in and reexamine.

It is harder to believe in Oscar’s guilt than his innocence. The destruction of evidence 5 months post conviction is downright criminal behavior in and of itself. Rotten in Denmark is the phrase that always comes to my mind when I think of Oscar.

It seems to me, that the arrangement of the tires on Oscar Clifton’s truck would have been the most damning piece of evidence against him. I wonder why he had them installed the way they were. I would think that they would have been paired and one set mounted at the front and the other at the rear of his truck.

I agree.  That's a good question and another thing to make me wonder if that was a very unique situation.  I just made a call to a tire shop to see how common or rare that might be.  The man told me that usually they like to do as you say but as to how rare or unique he said it's not uncommon at all.  He said he sees cars coming in with 4 different tires.  People can't afford things and just buy tires and just throw them on in any formation.  I do think it's odd though.  I would think most men would think like you do even if they install the tires themselves and not have the tire shop do it. 

I encourage people to listen to the 12-26-75 podcast for themselves, episode 27.  It does kind of make your head spin and you will get lost quickly unless you take notes. 

One thing the 12-26-75 podcasters point out is that the tracks were on the opposite side of the street on a busy road where a lot of trucks travel and 50' north of where Donna's underwear, sanitary napkin and belt were thrown out.

The tracks indicate a u-turn was made.

Again if Oscar killed her and stabbed her (I think it was 17 times), had her underwear in the truck as well as the sanitary napkin and belt, how was absolutely no trace evidence found in the truck.

The wheel base evidence may be exculpatory too.

That's a good point.  I wonder if he, himself mounted the tires that way.  It doesn't sound like a tire shop would.  It was brought up in court.  Here is some info on the tires that is exculpatory of Oscar:

Wheel base measurements were only taken on Road 176 near where Donna’s underwear were found, but 50’ north away and on the other side of the roadway.


Officer Hensley’s Report 12/27/1975: Wheel Base of tracks on Road 176 were 150”, Oscar’s truck wheel base 132” (18” difference)

Officer  Hensley testimony at trial 6/29/75: Vehicle tracks at scene: Wheel base 130”, Oscar’s Wheel base was 152” (22” difference)

Then DA Powell at closing argument said wheel base track at scene was about estimate 130”/Oscar’s 132” 2” difference!

DA Ward stated Oscar’s Wheel base was 152”


Morton: plaster casts:

The podcasters in their 12-26-75 podcast state that Morton took plaster casts of the vehicle tire tracks and concluded they did not match Oscar’s truck.

The podcasters are saying that Morton excluded Oscar’s truck.  Wait.....did he say that?  or didn't he?  Are they using the  mixed up measurements Sgt. Hensley testified to at trial to make this statement? 

WHAT THE HECK!

Where is the testimony about the plaster casts?

WHERE IS THE PROOF OF WHAT OSCAR’S WHEEL BASE WAS AND THE WHEEL BASE OF THE TRACKS!

To continue with tire description and placement:

Oscar had 2 different model BFGoodrich tires on his truck in an X position:
2 BFG Silverton Extra Mylar 715 Lt. with similar tread on Right Rear and Left Front
2 BFG Heavy Duty Express Nylon 715 LT Right front and Left Rear
(Only the track pattern can be said to be compatible and the position but not the Make, Model or Size from the tracks)

THAT SEEMS GOOD ENOUGH FOR ME IF I WERE ON THE JURY, BUT....WHAT ABOUT THE DIFFERENCE IN THE WHEEL BASE AT LEAST 18" OFF.  That is a real problem.


I'm not clear on if this same tire tread and position are at both Road 176 and the location of Donna's body at the orange grove, from what I have found so far from my notes it doesn't seem so, but I need to continue looking: 

Road 176:
Same tread design and same position on vehicle but no identifiable flaws. But make, model or size of tire is not known, just that the tread is the same on right front and rear back. AND same tread design is in the same position on Oscar’s vehicle.

Plaster cast at Rd. 176: the pattern is comparable to Left front and right rear and there is some identifiable degree of wear on right rear but same tread design.

List Avenue: Charles Morton could not tell because of soil and lighting. Can’t say tracks at the scene are Clifton’s but there is some significance to the wear comparison.

PODCASTERS SAY: Can’t state the tires are BF Goodrich, or make or model or size. Morton only said tread was maybe, kind of similar and only in the right light and only if you ignore half the fotos and ignore all the plaster casts which DEFINITELY DON’T MATCH.

Now back to something from the original post in this thread and the discussion with joke and Biagio and Todd Lindsey and their hypothesis that he didn't intend to abduct Beth Snelling:

Are they even aware of this:

2/5/75 10 p.m. YOUNGER prowler spotted by Snelling, white male 5’10” to 6’ collar length hair, dark plaid long sleeve shirt, shoe prints match VR.
8/2/75 OLDER PROWLER
9/6/75 Snelling’s vehicles broken into

Professor Snelling twice chased him off, once Beth saw him outside her window, once Beth heard him outside.

The Air Conditioner was not working. Why? I can't recall if it is known if it had been disconnected/unplugged, blocked up with something? So they slept with the window open.

Their window screen was found on the travel trailer across the street and a body imprint was in the dust on the top of the trailer indicating HE WAS LAYING UP THERE WATCHING.
I believe he was watching to see that everyone had returned home and had gone to sleep.

In the meantime he broke into the home on Redwood.

Question: Were the home owners of the travel trailer not at home? Was he planning on bringing Beth to their yard?

Probably silly, but IF Oscar Clifton was being framed by the VREARONS then acquisition of a similar truck and swapping out two of the wheels and arranging the tires on both trucks in the same distinctive pattern would be a clever gag. It would require having two tires mounted on rims that matched the rims on Oscar Clifton’s truck and his truck could be jacked up while it was parked and the switch made.

Your question isn't silly.  In this case it seems like anything is possible.  I’m trying to sort this all out myself.

I did think of the possibility of DeAngelo or someone else that wanted to frame Oscar changing the tire positions on his truck but I don’t think that would make sense unless the killer stole the truck to use and we know he didn’t.


First of all something new I just found out today thanks to murderinc:

Murderinc found 4 articles in the paper about Oscar’s brother-in-law, Avery Doula, having been broken into and ransacked. Three in 1973. The 12-26-75 podcasters list a string of break-in starting in 1973 when DeAngelo first appeared in Exeter. This may indicate Oscar was on DeAngelo’s radar for a long time.


Doula, the brother-in-law, lived right across the street from Oscar at 14657 Avenue 264. Oscar lived across the street at 14647 Avenue 265. (I have seen two of the articles that murderinc furnished me but they spell the name Charles A. Dula but the address is the same for Avery Doula. So Charles A. is no doubt Charles Avery Doula. And Dula is probably a misspelling.)


I’m thinking of the pros and cons of Oscar being framed:


Pro: It’s suspicious that Oscar’s invoice book was found by Donna’s bike and no fingerprints were on it.


Con: If a cop that knows how to handle evidence wanted to plant the receipt book it seems he would have stolen it with gloves on and not wiped Oscar’s prints off of it.


Pro: Was it DeAngelo harassing Oscar’s daughter in front of the K-Mart and when they went into the store did he quickly swipe the invoice book from inside the car and then realize that his own prints would be on it so wiped all prints off?


Question: I wonder if Oscar’s daughters recognize DeAngelo as being the person that was harassing them in front of the Kmart on Christmas Eve when it is thought by Oscar’s side that the receipt book was probably stolen.


Pro: The VR loot dropped in the canal in two locations near Oscar’s parents’ home on Hypericum Rd (one being almost across the street.)


Pro: Would Oscar throw out Donna’s clothes and shoes on the way to his own house? Unlikely and this seems more like framing. It is also very reminiscent after the Offerman/Manning murders of the twine being dropped in several locations -- in the vacant condo next door where AS had been playing Dungeons and Dragons with his friends, then dropped out on the patio, then on the path along the creek, and then on the footpath on N. Kellogg, and finally landing on the lawn of A.S. at the sidewalk where it couldn't be missed.


Pro: Why kill Donna and try to frame Oscar? Possible answer to distract LE. He had just shot at McGowen and McGowen got a good look at him.


Con: How would DeAngelo know that Oscar would not have an alibi?


Pro: Perhaps DeAngelo spotted Oscar in the area driving around or maybe a call came into the police about someone harassing girls in the area and he decided that was the perfect time to act. If that is the case, then Donna was not planned but just a victim of opportunity.


Pro: No foot prints of Donna near her bike. Does this indicate the bike was dropped off after her murder? The timeline would not have permitted Oscar enough time to do that.


Question: If she was not abducted from that location and there were no footprints, no sign of a struggle, why drop the bike off there?

In the podcast, the Exeter Sun-Gazette editor-in-chief, Paul Myers calls the 12-26-75 podcast a "conspiracy theory" - which is an opinion at this point.  But the destruction of evidence you refer to was a documented criminal conspiracy, a fact. Yet these Sun-Gazette newspeople are not asking why it was done.

Right, he did call it a conspiracy theory.  Maybe these news people do not consider themselves "investigative" reporters, but it they are going to weigh in and say derogatory things then they should do some investigation and at least put some time and effort into it.   

Personally, I do think it smacks as a conspiracy theory but that doesn't mean they are wrong.  They could be right, or maybe they are partially wrong.   I think they do go too far though and have hurt themselves by claiming everyone seemed to be in on a conspiracy.  A lot of people will probably tune out because of that. 

Where I think they go too far is in saying Sheriff Byrd was out to get Oscar in a personal vendetta and coerced the victim, initials C.G.,  at the river to testify against an innocent man; and the citizen patrol guy on the bridge was also out to get Oscar; so was Oscar's own lawyer, Donovan, and committed suicide because of it; so was Oscar's own Private Investigator.  This makes me believe the 12-26-75 podcast lawyers are no doubt biased. They themselves are weaving their lawyer magic and twisting things. 

Actually I fear both sides have done that,  so I do keep that in mind.

If they had stuck to saying "yes, Oscar was a jerk, he was acting out, but he wasn't a murderer. 
He was framed by a serial killer that it is speculated framed other people and was a cop in Exeter and no doubt knew about Oscar's record -- that he was the perfect person to frame.   
Or....the DA and the sheriff believed Oscar was guilty and stopped at nothing -- hiding evidence, destroying evidence etc. to be sure he was found guilty, but in doing that the real killer went free.

The DNA evidence -- so it is stated that it excludes DeAngelo but does not exclude Oscar.  The podcaster/lawyers have a lot to say about the handling of that DNA.  So LE does not agree with them?  Who is correct?  

If the podcasters are right about the DNA, then I think this bears looking into again but by an independent agency.

He was framed by a serial killer that it is speculated framed other people and was a cop in Exeter and no doubt knew about Oscar's record -- that he was the perfect person to frame.   
Or....the DA and the sheriff believed Oscar was guilty and stopped at nothing -- hiding evidence, destroying evidence etc. to be sure he was found guilty, but in doing that the real killer went free.

The DNA evidence -- so it is stated that it excludes DeAngelo but does not exclude Oscar.  The podcaster/lawyers have a lot to say about the handling of that DNA.  So LE does not agree with them?  Who is correct?  

If the podcasters are right about the DNA, then I think this bears looking into again but by an independent agency.

I'm still taking in the information on the Clifton case(s), so I don't have a strong opinion on a lot of it. The powers-that-be have yet to come forward with detailed answers on specific questions (the lab sample contamination, the suppressed witnesses, the original defense team incompetence/malfeasance.)

If it's true that the TCSO committed criminal destruction of evidence, how does that fit into the official story?What reason do they give for doing it?  

For journalists: the people involved in these events aren't getting any younger - if you want to hear the story straight from the horses mouth (though some have already refused to talk).

I listened to the 12-26-75 episode 27 this morning and it sounded as though there was NO evidence that connected any tire tracks to Oscar Clifton’s truck. The two different models of tires were on his truck in the arrangement that has been discussed but there were no tire tracks found that matched. There was one track that was similar to one of Oscar Clifton’s front tires but the expert witness could not say for certain that it was exact. There were no tire tracks that matched Oscar Clifton’s truck found. I’ve yet to hear any evidence tying Oscar Clifton to this crime other than the receipt book but that’s just as good, if not better, evidence for a case being made that he was being framed by a devious cop/sex criminal/murderer.
