With all the charges against JJD, do you think the DAs have considered the possibility of a split decision - convicted of the cases with direct dna evidence but acquitted of other cases ?
Most of the Ear crimes that will be presented are linked more by MO than by an physical evidence ( that we know of ) . The dna evidence for all but the 3 Contra Costa cases is long gone. It’s possible that the Snelling and Maggiotr cases have strong physical evidence but what evidence do they have that links him to the burglary / kidnapping charges that could convince a jury ?
If he is convicted of some charges but acquitted of others what impact will that have on the survivors of the cases where he gets off ?
I fully believe he is responsible for all of the crimes but if I was on a jury and had to consider cases with no dna , no finger prints, no evidence that he was in the area that night, and no positive ids would I feel that the patterns of behavior or the ligatures were enough to link him from the dna cases to these other case? I’m not sure that I could . Of course there may be other evidence but am going on what is publically known. And we don’t know what if any case will be offered by the defense . If he was signed in working for Auburn PD at the same time as a number of the rapes then we have to either assume that Auburn PD did not a have a clue that an officer was awol on numerous occasions covering the crime and the stalking prior to the crime or that it was the early morning rapist or one if the other criminals that were active in the same time period . Or the defense could just hire kg to give evidence on why he thinks Coe was involved and everything falls apart.
But seriously , does it seem reasonable to prosecute the kidnapping burglary charges if the cases could get acquitted . If they only prosecuted the murders with dna or other physical evidence and he was convicted , I suspect that people would accept that he also was EAR without the need to prosecute the EAR crimes.
but if they overcharge then it risks conviction of the ONS cases and acquittal of the EAR or VR related charges will people accept that he was the EAR and the VR?
